Who can order?

Under West Virginia law, birth certificates of births less than 100 years old are considered “closed records.” Only individuals showing a legitimate and tangible interest may be issued certified copies of birth certificates upon paying the appropriate fees, providing proof of identification, and filling out the application form:

The individual whose name appears on the birth certificate (registrant) if 18 years or older; or are emancipated by court order or marriage

The registrant’s parents listed on the record

The registrant’s spouse, children, or grandchildren

Anyone with tangible legal interest in the document
